Acknowledgment and Assumption of Risk
By renting a dumpster from Dump Dog ("Company"), you ("Customer") acknowledge that use of the dumpster involves inherent risks of property damage and personal injury.
Release of Liability
Customer hereby RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE Dump Dog, its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by Customer or any third party, or to any property belonging to Customer or any third party, whether caused by the negligence of Dump Dog or otherwise, while using the rented dumpster, EXCEPT for gross negligence or willful misconduct by Dump Dog.
Property Damage Waiver
Customer specifically releases Dump Dog from liability for any damage to:
- Driveways, sidewalks, lawns, or landscaping
- Underground utilities, septic systems, or irrigation lines
- Overhead power lines, tree branches, or structures
- Any property damage resulting from Customer's failure to properly identify safe placement locations
Misuse and Improper Use
Customer acknowledges that improper use includes, but is not limited to:
- Exceeding weight limits or overfilling the dumpster
- Placing prohibited materials (hazardous waste, chemicals, paint, batteries, tires, )
- Using the dumpster for purposes other than waste disposal
- Allowing unauthorized persons to use or access the dumpster
- Moving the dumpster from its designated placement location
- Climbing on, into, or hanging from the dumpster
Indemnification
Customer agrees to INDEMNIFY AND HOLD HARMLESS Dump Dog from any claims, lawsuits, damages, costs, or expenses (including attorney fees) arising from Customer's use or misuse of the rented dumpster.
Pricing & Rental Periods
- Customer must call to schedule pickup of their dumpster rental.
- Rentals are on an on call basis and will only be pickup up when scheduled by the customer.
- Dumpster rental has two seasonal categories:
- Peak Season (March through October): Rentals include the first 7 days
- Off Season (November through February): Rentals include the first 14 days.
- After the included rental period (7 days for peak / 14 days for off season), a $10 per day fee will be charged until the dumpster is scheduled for pickup.
Standard Rates:
- 15-yard dumpster: $370 for 7 days
- 30-yard dumpster: $525 for 7 days
Additional fees apply after the initial rental period ($10 per extra day).
Customer Acknowledgments
Customer acknowledges that:
- They have read and understand these terms
- They voluntarily assume all risks associated with dumpster use
- They understand that Dump Dog has provided protective roller pads to minimize property damage
- They agree to use the dumpster in accordance with all provided guidelines
- This agreement is legally binding and enforceable
This agreement shall be governed by the laws of the State of Michigan. If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
